1. PRIVACY

Nay Palad GmbH, Rosenheimer Landstrasse 74, 85521 Ottobrunn, Germany (hereafter "Nay Palad") takes the requirements of the Data Protection Act quite seriously and wants to ensure that your sphere of privacy as a user of the Nay Palad offers will be protected. For this reason, Nay Palad has issued a declaration of data protection, in which the treatment of your personal data is explained for customers of Nay Palad. Nay Palad retains the right to change the content of this declaration of data protection from time to time. For that reason, the declaration of data protection should be reviewed at periodic intervals for new knowledge.


2. GENERAL INFORMATION

Nay Palad shall be obligated to comply with applicable data protection law, in particular the stipulations of the Bundesdatenschutzgesetz (German data protection act, hereafter “BDSG”) as well as the Telemediengesetz (German telecommunications act, hereafter “TMG”). Nay Palad shall process and use your personal data only if you have presented your consent or a legal guideline permits the acquisition, processing or usage. Only that data will be process or used that is required for the performance of our services and the use of our web pages or data that you have freely shared with us.


3. Personal Data

Personal data means any information relating to an identified or identifiable natural person. An identifiable natural person is one who can be identified, directly or indirectly, in particular by assignment to an identifier such as a name, an identification number, location data, an online identifier or to one or more special characteristics which express the physical, physiological, genetic, psychological, economic, cultural or social identity of that natural person;


4. USE OF PERSONAL DATA

Nay Palad stores your personal data and uses it to contact you, for example to communicate with you in response to your questions or to send you product or promotional material including e-mails, or other information material from Nay Palad. Nay Palad will not, without your express consent, release your personal data to third parties outside the Nay Palad GmbH. External service providers who process data on instructions for us will be subject to a strict contractual obligation in the spirit of the Federal Data Protection Act and should therefore not be regarded as third parties for the purposes of data protection law. These service providers will in particular be prohibited from using your data for any other purposes than those originally agreed. 

You may revoke the declaration of approval issued to Nay Palad at any time with effect for the future. In addition, you may revoke this usage, to the extent that we use your data for marketing measures for example in the legally permissible framework. 6. Types of personal data

We generally process the following types of personal data

  • Title, first and last name
  • Postal address/s
  • Telephone and fax number/s
  • E-mail address/es
  • Other information required for order and contract processing


7. Purpose of data collection

We collect your data for the following purposes:

  • Execution and handling of order and contractual relationships, including correspondence
  • Fulfilment of contractual and possibly existing legal obligations
  • Appropriate advice 
  • Transmission of information material in the context of the contractual relationship (customer relationship); this does not include sending information material to non-customers as part of advertising campaigns. A customer relationship is to be assumed over the entire term of a contract.


8. Recipients of personal data

Your personal data will only be passed on to third parties on your behalf and with your consent. In the context of contract processing, we pass on your data to the following recipients as far as necessary:

  • To tax authorities and courts 
  • If necessary to tax consultant 
  • To contractors with whom an order data agreement (e.g. IT services, etc.) has been concluded
  • Depending on the order to other recipients, which we will coordinate with you


9. Data transmission to third countries

Data will be transmitted to third countries (countries outside the European Economic Area - EEA) if this is necessary or reasonable for the execution of an order or contractual relationship, if you have given us your consent or if this is otherwise legally permissible. In this case we take measures to ensure the protection of your data, e.g. through contractual regulations. We only transmit to recipients who ensure the protection of your data in accordance with the regulations of the EU-GDPR for the transfer to third countries. 


10. DATA SECURITY, EXTERNAL LINKS

Nay Palad gives an undertaking to ensure secure treatment of your personal data and to take appropriate precautionary measures to protect it against loss, abuse or falsification. Nay Palad is not liable for the contents of other suppliers who can be reached through the hyperlinks on our websites. Many links on our websites refer to contents which are not stored on our own servers. External contents have been checked for accuracy and criminal liability when the links were set up. Nevertheless, the possibility cannot be ruled out that contents from suppliers will be subsequently changed. Nay Palad is not required to keep this under constant monitoring and therefore rejects any liability.


11. Storage of personal data

Your personal data will be stored by us for the duration of the contractual relationship and thereafter for a maximum of three years, unless there are longer legal retention regulations. If the data is required for tax/commercial purposes, the retention period is ten years. The start of the period is the end of the contractual relationship or the process at the latest. We will delete your data after this retention period has expired.


12. COOKIES

Nay Palad will use cookies in order to be able to recognize you as a customer during your visit to the web site and as part of our services and in order to store technical data for the proper functioning of individual offers on your computer. A cookie is a text file that is stored on your computer and that makes analysis of your usage of the web site possible. Nay Palad ultimately only saves session and serial numbers about your visit by means of these cookies. If you should desire not to use cookies, you may block their use in your browser. Details will result from the instruction of your browser manufacturer. That important parts of our web site and the services provided there will not function properly cannot be excluded.


13. GOOGLE ANALYTICS

This website uses Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses “cookies”, which are text files placed on your computer, to help the website analyze how users use the site. The information generated by the cookie about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google’s behalf. Google will not associate your IP address with any other data held by Google. By using this website, you consent to the processing of data about you by Google in the manner and for the purposes set out above.


14. Your rights

You have the following rights as data subject:

  • You have the right to access certain information when we process your personal data in accordance with Art. 15 EU-GDPR. In particular, you can obtain information about the purpose of the processing, the recipient of the data, the planned storage period or the existence of a right of appeal.
  • You have a right to correction and completion if your personal data is stored incorrectly or incompletely with us, in accordance with Art. 16 EU-GDPR.
  • You may have the right to have your personal data deleted in accordance with Art. 17 EU-GDPR. Unless the processing is necessary for the exercise of the right to freedom of expression and information; for the fulfilment of a legal obligation; for reasons of public interest or for the exercise or defence of legal claims.
  • You may have a right to limited processing of your personal data in accordance with Art. 18 EU-GDPR. This is the case if you dispute the accuracy of your personal data; the processing is unlawful and you request the restriction of the processing instead of deletion; we no longer need the data for our processing or you object to the processing, pursuant to Art. 21 EU-GDPR.
  • You have the right to transfer your data in a structured, common and machine-readable format, in accordance with Art. 20 EU-GDPR.
  • If the processing of your personal data is based on your consent, you have the right to revoke this consent at any time, in accordance with Art. 7 Para. 3 EU-GDPR. In the event of revocation, we will stop processing the data for the purposes to which the revocation relates. The legality of the data processing before the revocation remains unaffected. An informal communication to us, e.g. by e-mail, stating which data processing you object to, is sufficient for exercising the revocation.
  • You have a right of appeal to the supervisory authority if you believe that our handling of your personal data violates the EU-GDPR, pursuant to Art. 77 EU-GDPR. The complaint may be lodged with the supervisory authority at the place of your habitual residence, your place of work or the alleged infringement. 
  • If we process your personal data to safeguard legitimate interests within the meaning of Art. 6 para. 1 subparagraph 1 letter f EU-GDPR, you have the right under Art. 21 para. 1 EU-GDPR to object to such processing for reasons arising from your particular situation. You can object to the processing for direct advertising purposes at any time without giving reasons pursuant to Art. 21 para. 2 EU-GDPR. In order to exercise your right of objection, it is sufficient to inform us informally, e.g. by e-mail to us, stating which data processing you object to.
